Welcome to Miugifts! The terms “we”, “us” and “our” refer to Miugifts. Miugifts operates this store and website, including all related information, content, features, tools, products and services in order to provide you with a curated shopping experience (the “Services”). Miugifts is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with the policies referenced herein, describe your rights and responsibilities when you use the Services. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

You represent that you are at least the age of majority in your jurisdiction and you consent to allow any of your minor dependents to use the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant such information is accurate and that you have rights to provide it. We strive to display products accurately; however, colors/appearance can vary by device and settings. We do not warrant that any product will meet your expectations or exactly match on-screen depictions. Product descriptions, availability, and designs may change at any time without notice; we may limit quantities or discontinue items at our discretion.

IP & Affiliation: Our designs are fan-inspired and not affiliated with or endorsed by any team, league, or player. We do not use official team/league branding.

SECTION 3 - ORDERS

Placing an order is an offer to purchase. We may accept or decline any order at our discretion; your order is accepted only when we confirm and process your payment. Review your order carefully before submitting; we may be unable to accommodate cancellations after acceptance. If we do not accept, modify, or cancel an order, we will attempt to notify you using the contact details provided.

Your purchases are subject to our Refund Policy and Return Policy. You represent that purchases are for personal/household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price in effect at checkout and stated in your order confirmation. Unless stated otherwise, prices exclude taxes, shipping/handling, and customs/import charges. You agree to provide current, complete, and accurate purchase/payment information and to promptly update it as needed.

SECTION 5 - SHIPPING AND DELIVERY

All orders are made to order and are produced & shipped from Vietnam with tracking. Our US address is administrative only and not a warehouse or return center. See our Shipping Policy for handling times, delivery estimates, duties/taxes, address changes, and lost/damaged parcel procedures. Delivery times are estimates and not guaranteed. Title and risk of loss pass to you when we transfer products to the carrier.

Miugifts and related marks are trademarks of Miugifts; Shopify and related marks are trademarks of Shopify; other names and logos are the property of their owners.

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the third party’s terms. New features/resources may be offered and will be subject to these Terms.

The Services may contain third-party materials or links. We are not responsible for examining or evaluating third-party content or sites, and we are not liable for related purchases, services, or content. Review third-party terms and policies before transacting.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Miugifts is powered by Shopify. Sales and purchases are made directly with Miugifts. Shopify is not responsible for any aspect of sales between you and Miugifts. You expressly release Shopify and its affiliates from claims arising from or related to your transactions with Miugifts.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify may also process your information to provide/improve the Services. Information you submit may be transmitted to and processed in countries other than where you reside. See our Privacy Policy for details.

If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback for any purpose. WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE USE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; SOME LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MIUGIFTS, SHOPIFY, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE/DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

You agree to indemnify, defend, and hold harmless Miugifts, Shopify, and their affiliates and personnel from claims arising out of your breach of these Terms, violation of law or third-party rights, or your use of the Services. We may control the defense at your expense; you will cooperate and provide relevant information.

SECTION 18 - SEVERABILITY

If any provision is unlawful or unenforceable, it will be enforced to the maximum extent possible, and the remainder will remain in effect.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

No waiver of any term shall be deemed a further or continuing waiver. These Terms and policies posted on the site constitute the entire agreement between you and us regarding the Services and supersede prior agreements. Ambiguities shall not be construed against the drafting party.

You may not assign these Terms or your rights/obligations without our prior written consent. We may assign or delegate without notice.

SECTION 21 - GOVERNING LAW

These Terms and any related disputes are governed by the laws of the State of Delaware, USA, without regard to conflicts of law principles. You consent to venue and personal jurisdiction in the state and federal courts located in Delaware.
